The following Terms & Conditions apply to all orders placed by the Customer, hereinafter referred to as 'you', with Ramon Curmi, hereinafter referred to as 'Under The Sky of Malta' or 'we', for all products displayed on the website.

This online shop is owned and operated by Ramon Curmi. These Terms and Conditions govern your use of the website. By visiting or shopping on Under the Sky of Malta online, you agree to be bound by these Terms and Conditions of use, as well as other policies posted on the website.

By using the services, you warrant to Ramon Curmi that you have the legal capacity to enter into these Terms & Conditions with us. Under The Sky of Malta does not sell to minors; if you are under the legal age, please ask a parent or Legal Guardian to effect the purchase on your behalf.

By using, viewing, transmitting, caching, storing, and/or otherwise utilizing this website, the services, or functions offered herein and/or contents or information on this website, you agree to each and all of the terms and conditions set out herein, and waive any right to claim ambiguity or error in this Agreement. Should you not agree to each and every term and condition set out herein, you are asked not to use this website and leave immediately.

Every effort has been made to display the colors of products on the online shop as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.

Under The Sky of Malta does not represent or warrant that the descriptions of any products shown on the website are accurate and complete. If a user purchases a product from the website that is not as described, the user’s sole and exclusive remedy shall be to return the product in an unused condition for a refund for the value of the purchase as indicated in the Refunds & Returns policy section.

All prices displayed on the website are indicated in Euro and are inclusive of applicable Malta VAT rates of 18%.

We have the right to cancel any orders at our discretion and at no charge to the client. In this event, the client will be given a full refund for the value of that purchase.

Consumers may use their credentials to have the online facility to gain access to ‘My Orders’ and view concluded contracts.

We have the right to cancel any orders for products that have been listed at an incorrect price, rebate, or refund, or contain incorrect information or typographical errors or are unavailable for any reason.

If any provision of these Terms & Conditions shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

 

Product Availability

All product orders are subject to availability of the same. Along this line, if there are difficulties regarding the supply of products or there are no more items left in stock, we reserve the right to provide you with information on substitute products of the same or higher quality and value that you may order. If you do not wish to order the substitute products, we will reimburse any amount that you may have paid.

 

Refusal to Process an Order

We reserve the right to remove any product from this website at any time and to remove or modify any material or content from the same. Although we will always do everything possible to process all orders, there may be exceptional circumstances that force us to refuse to process an order after having sent the Order Confirmation, and we reserve the right to do so at any time.

 

Refund & Returns Policy

By law, all goods purchased from Under The Sky of Malta can be returned within 14 days from the date of purchase. The items have to be in perfect conditions and labels must be intact, corresponding receipt has to be included in the return. In order to proceed with a return, please send an email to receive the destination address. We reserve the right to refuse any opened or damaged goods at our discretion. Once the goods have been inspected and the return has been approved, you will receive a confirmation email indicating that the refund will be paid to your account within a few days. Postage fees for returns are the responsibility of the client. In case of bank fees applicable while refunding, this cost must be borne by the client.

 

Defective Goods

We only sell items in perfect condition, so if you ever receive an item that is not, please contact us via email.

Under The Sky of Malta gathers the personal details of clients that pertain to the order processing and order collection/delivery. We keep the details safe and do not divulge them to third parties.

All online purchases shall be paid via bank transfer, online card, or cash on delivery.
